Terms of Service
Effective date: March 28, 2026
These Terms of Service ("Terms") govern your access to and use of the Sector Fit mobile application ("App") operated by Sector Fit ("we", "us", or "our"). By creating an account or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance & Eligibility
- ·You must be at least 13 years old to use the App (16 years in the EU/EEA or jurisdictions requiring a higher age for digital consent).
- ·If you are under the applicable minimum age, you must have verifiable parental or guardian consent.
- ·By accepting these Terms you represent that all information you provide is accurate and current.
- ·You may only maintain one account. Creating multiple accounts to gain competitive advantage is prohibited.
2. Account Responsibilities
- ·You are solely responsible for maintaining the confidentiality of your password and all activity under your account.
- ·Notify us immediately at lucas@sector.fit if you suspect unauthorized access to your account.
- ·You must not share your account credentials with any other person.
- ·We reserve the right to refuse service, terminate accounts, or remove content at our discretion.
3. Acceptable Use
You agree to use the App only for its intended purpose — legitimate outdoor physical activities. The following are expressly prohibited:
3.1 Cheating & Fraud
- ·GPS spoofing, location faking, or any technique that falsifies your position
- ·Submitting fabricated activities, importing routes from other apps as live activities, or using bots
- ·Manipulating pace or distance data to circumvent validation rules
- ·Exploiting bugs, glitches, or unintended behaviours for competitive gain
3.2 Prohibited Conduct
- ·Harassing, abusing, or threatening other users
- ·Attempting to reverse-engineer, decompile, or extract source code from the App
- ·Accessing or attempting to access other users' accounts or data
- ·Transmitting malware, viruses, or any code designed to disrupt the App
- ·Scraping, bulk-collecting, or automated access to the App's data or API
4. Activity Rules & Limitations
To ensure fair play and data integrity, the App enforces the following rules automatically:
- ·Daily distance cap: a maximum of 42 km per day may be credited toward sector contributions.
- ·Pace validation: GPS points that indicate an implausible speed (e.g. faster than a world-record pace) are filtered out.
- ·New-member waiting period: newly joined group members must wait a pre-established period before contributions count toward that group's sectors. This prevents group-hopping behaviour.
- ·Minimum GPS accuracy: location points with poor accuracy are discarded to maintain data quality.
We may adjust these rules at any time to maintain fair competition. Changes will be communicated via an in-app notice.
5. GPS & Activity Disclaimers
- ·GPS technology is inherently imprecise. We are not responsible for errors, inaccuracies, or gaps in location data.
- ·Sector contributions depend on GPS data quality, which may vary based on device, environment, and signal conditions.
- ·The App is not a navigational or safety device. Do not rely on it for route-finding in emergencies.
- ·We are not responsible for any incidents, accidents, or injuries that occur during physical activities.
6. Intellectual Property
6.1 Our Property
The App, including its design, graphics, logos, text, features, and underlying code, is owned by Sector Fit and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the App without our written permission.
6.2 Your Content
You retain ownership of the activity data you generate. By using the App you grant us a worldwide, royalty-free, non-exclusive licence to store, process, and display your activity data and username in leaderboards, sector maps, and group statistics within the App.
7. Limitation of Liability
To the fullest extent permitted by applicable law:
- ·The App is provided "as is" without warranties of any kind, express or implied.
- ·We do not guarantee uninterrupted, error-free, or secure operation of the App.
- ·We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to data loss, injury, or lost profits.
- ·Our total liability to you for any claim arising out of or related to these Terms shall not exceed the amount you paid us in the twelve months prior to the claim (or US$10 if you have not paid anything).
8. Account Suspension & Termination
8.1 By Us
- ·We may suspend or permanently terminate your account for any violation of these Terms, including but not limited to cheating, fraud, or abusive behaviour.
- ·We may also terminate accounts that have been inactive for more than 24 months.
- ·Where practicable we will notify you of the reason; however notification is not required for serious violations.
8.2 By You
You may delete your account at any time from within the App (Settings → Account → Delete Account) or by emailing lucas@sector.fit. Upon deletion your personal data will be removed in accordance with our Privacy Policy.
9. Modifications to the Terms
We reserve the right to update these Terms at any time. We will notify you of material changes via an in-app notice at least 14 days before they take effect. Continued use of the App after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes you must stop using the App and may delete your account.
10. Governing Law & Dispute Resolution
- ·These Terms are governed by the laws of Brazil, specifically the Brazilian Consumer Protection Code (CDC), the Brazilian General Data Protection Law (LGPD), and the Brazilian Civil Code.
- ·Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation.
- ·If negotiation fails, disputes shall be submitted to the competent courts of São Paulo, Brazil, unless applicable consumer protection law mandates otherwise.
- ·If you are an EU/EEA resident, you may also submit a complaint to your local data protection authority.
